probably a double edged sword. Certainly one wants to prevent possible abuses from being a non-profit. On the other hand, how many cost effective state agencies do you know of?

GILBERT — A special Gilbert Town Council meeting was arranged for Jan. 22 to discuss Trailfest for 2015. The Larry Joe Harless Community Center and the town of Gilbert must reach several agreements before the planning can move forward.


Cheryl Mitchem, Executive Director of LJHCC, wrote up a memorandum of understanding for the town to look over and sign. The memorandum included agreements on insurance, security, wristband passes, vendors and contractors to prepare and reclaim the properties to name a few.


Although LJHCC is willing to work with the town on Trailfest, mayor Vivian Livingood is unwilling to sign and agree on the memorandum of understanding due to specific items listed within.


Livingood stated that the town does not wish to make any money on Trailfest and that she is willing to allow LJHCC to keep all money made aside from what it will cost to actually put the event on. But funding is a major issue, as the town is limited on funding availability.


The well-known mud pit and dirt track are looking like one of the funding issues between the town and LJHCC. LJHCC has stated that there is a possibility they may have the work of the digging and reclaiming done by a volunteer but it still isn’t set in stone. The town also had an offer from a contractor to do the work for $6500, in which the majority of that cost may possibly be lowered if the town is able to obtain sponsorship. Regardless of who is chosen to do the work, they must also be insured and covered under worker’s compensation. Livingood is still uncertain if she will have the mud pit and dirt track this coming year because of the funding issue as there is much more to preparing the land than digging and reclaiming. The land must be cleaned, holes filled in and it must also be hydro-seeded and covered with straw, which is another debt that the town must cover.


If the town decides against the dirt track and mud pit then other activities will be planned to take their place. Although many decisions are still up in the air being tossed here to there and regardless of who is making money, mud pit or not, the town plans to proceed with Trailfest and do the best to their ability to keep it going for the town of Gilbert.

Surfing the WV legislature, I found several 'findings'. Of note:

The Authority leases an industrial storage building from the Wyoming County Economic Development
Board, for which one Authority board member is an employee and one Authority member and the
Authority's Executive Director serye on its Board, under an operating lease on a month-to-month basis.
Rent expense for the operating lease was $14,500 and $13,500 for the years ended December 31, 2013
and 2012, respectively.

The Authority obtained liability insurance through an insurance agency owned by a board member.
Insurance premiums paid to this agency were $135,437 and $127,649 for the years ended December 31,
2013 and 2012, respectively.

The Authority obtained contracted part time labor through a company for which the Authority's Executive
Director and an Authority Board member serve as board members. Total expenses paid to the Company
were $245,192 and $247,079 for the years ended December 31,2013 and 2012, respectively. In
addition, the Authority had accrued expenses of $15,661 and $10,077 as of December 31, 2013 and
2012, respectively.

The Authority obtained building maintenance services through a company for which the Authority's
Executive Director is a board member. Total expenses paid to the company were $19,449 and $160 for
the years ended December 31,2013 and2O12, respectively.

The Authority obtained printing services through a company owned by the Deputy Executive Director's
father. Total expenses paid to the company were $6,740 and $8,343 for the years ended December 31,
2013 and 2012, respectively. In addition, the Authority had accrued expenses of $8214 as of December
31,2012.

The Authority obtained catering services through a company owned by the Executive Directo/s mother
for Board meetings and staff meetings. Total expenses paid to the company were $2,48S and $3,399 for
the years ended December 31, 2013 and 2012, respectively.

The Authority obtained vehicle maintenance services through two companies owned by a board member.
Totaf expenses paid to the companies were $16,511 and $7,794 for the years ended December 31,2013
and 2012, respectively.

During the year ended December 31 , 2012, the Authority received funds from the \M/ Division of Tourism
grant for which the Executive Director serves as a board member for \A/V Division of Tourism. Total funds
received were $36,719 for the year ended December 31,2012.

I noticed Fisher doesn't ride your trails for cheap.
